Your Human Rights

This page includes information about your Human Rights and how you can expect to be treated when engaging in our services.

What are human rights?

Human rights are a set of rights designed to recognise the values of each person, regardless of where they come from, where they live and what they think or believe. They’re based on dignity, equality and mutual respect and are about being treated fairly and having the ability to make our own choices regarding our lives.

What are your rights?

Human rights in Queensland

In Queensland, your human rights are protected by the Human Rights Act 2019. The Act protects 23 fundamental human rights which have been influenced by international human rights law and the United Nations Declaration of Human Rights. Your rights include:

  1. Recognition and equality before the law
  2. Right to Life
  3. Protection from torture and cruel, inhumane or degrading treatment​
  4. Freedom from forced work​
  5. Freedom of movement
  6. Freedom of thought, conscience, religion and belief
  7. Freedom of expression
  8. Peaceful assembly and freedom of association​
  9. Taking part in public life
  10. Property rights
  11. Privacy and reputation
  12. Protection of families and children
  13. Cultural rights
  14. Cultural rights – for Aboriginal and Torres Strait Islander peoples
  15. Right to liberty and security of a person
  16. Humane treatment when deprived of liberty
  17. Fair hearing
  18. Rights in criminal proceedings
  19. Right to be treated with special protection during criminal processes (for children)
  20. Right not to be tried or punished more than once
  21. Retrospective criminal laws
  22. Right to education
  23. Right to health services.

Your rights when using our services

As a client of our service, you have the right to:

  • Be treated with dignity, respect and courtesy by all members of our teams
  • Receive services that value and respect cultural diversity
  • Be informed of service options and to give your views regarding the development of your service plan and progress
  • Receive a service that’s empowering and free from discrimination or judgement
  • Receive a quality service, at all times
  • Privacy and confidentiality in full accordance with the law and/or policy
  • Provide feedback
  • Have an advocate or support person present
  • Withdraw from the service and to have help accessing other services
  • Have access to an interpreter if required.

Human rights complaints

If you feel your human rights have been breached, while utilising our service, or you are unhappy with our response, you have the right to access an external complaints agency and external advocacy/support agencies. This includes the right to escalate a human rights complaint to the Queensland Human Rights Commissioner if 45 days have elapsed and you’ve not received a response to the complaint, or you consider your response to be inadequate.
